StreetEasy Listings Quality Policy
Welcome and thank you for your interest in StreetEasy’s services. Zillow, Inc. (“Zillow” or “StreetEasy”) owns and operates the StreetEasy brand. Users (“you”) of the StreetEasy brand’s services (including all services operated by Zillow under the StreetEasy brand, related data, and/or related services) (collectively, the “Services”) acknowledge and agree to comply with this StreetEasy Listings Quality Policy (the “Policy”).
- 1.Same-Day Requirement: Submission Requirement for Publicly Marketed Sale Listings
- 1.1.Marketing Listings. On the same calendar day of publicly marketing any property that is subject to an exclusive agreement to list the property for sale (“Sale Listing”), the listing agent must directly submit the Sale Listing for display on the Services through our direct entry listing creation service (“Direct Entry”). For the avoidance of doubt, any Sale Listing provided to StreetEasy pursuant to this Policy shall at a minimum include (i) the same data points and media as the Sale Listing appears on an MLS, brokerage’s website, or any third-party website or similar public-facing portal, and (ii) all data fields required by Direct Entry. For purposes of this Policy, an “MLS” is a centralized database, whether or not affiliated with the National Association of Realtors® (“NAR”), through which cooperating real estate professionals from different brokerages share information about properties for sale in a particular geographic region, including REBNY’s Residential Listing Service (the “RLS”).
- 1.2.Definition of “Public Marketing”
- 1.2.1.For the purposes of this Policy, “public marketing” means promoting, marketing, or advertising a Sale Listing to the general public in any manner. Public marketing includes but is not limited to displaying the Sale Listing on any public-facing website, mobile app, or internet real estate portal, placing the Sale Listing in a multi-brokerage listing sharing network, and/or placing the Sale Listing in an MLS for sharing with other MLS participants and/or distribution and display on MLS participant sites. For the avoidance of doubt, sending and/or transmitting a Sale Listing, regardless of status, to the RLS solely for visibility to other RLS member participants is considered “public marketing.”
- 1.2.2.For purposes of this Policy, a Sale Listing is not “publicly marketed” if all of the following conditions are met:
- The seller directs the listing agent in writing not to disseminate the Sale Listing in the MLS;
- The Sale Listing is shared only among agents within the listing brokerage and their clients through 1:1 communication;
- The Sale Listing is not otherwise publicly marketed as defined in this Policy; and
- The seller for such Sale Listing has signed a waiver/opt-out form that specifically directs the listing agent not to publicly market the Sale Listing on websites and platforms accessible to the general public and includes sufficient information to allow the seller to consider the potential drawbacks of withholding it from the general public (“Seller Waiver”).
- 1.2.3.For clarity, Sale Listings in a brokerage’s private listing network are considered “publicly marketed” under this Policy if either of the following applies:
- The private listing network, or a broker’s inventory of Sale Listings held off MLS and/or held off the Services, is actively marketed to consumers, including through any public-facing website; or
- Consumers can access the Sale Listings behind a login or registration wall.
- 1.3.Non-Compliant Sale Listing.
- 1.3.1.If a Sale Listing does not comply with this Policy, we will not display such Sale Listing on the Services (whether directly or through an MLS or other third party data feed) so long as the Sale Listing remains with the same listing agent or brokerage, regardless of any amended or subsequent listing agreement. We reserve the right to enforce this provision in our sole discretion.
- 1.3.2.Brokerages, teams, and/or agents that publicly market any Sale Listing and do not submit to the Services in accordance with this Policy will be deemed “Non-Compliant Participants.” StreetEasy reserves the right to indefinitely restrict certain features, products, and offer modified services to Non-Compliant Participants or their agents at any time, at StreetEasy’s discretion.
- 1.4.MLS Rules. These apply to Sale Listings regardless of any applicable MLS rule, or any other local regulation or rule, that allows agents to publicly market an off-MLS listing for any period of time exceeding the same calendar day required for entry into the Services pursuant to this Policy.
- 2.Advertising and Claiming Listings
- 2.1.By Owner Listings: For Rent By Owner and For Sale By Owner. To advertise a property as For Rent By Owner (“FRBO”) or For Sale By Owner (“FSBO”) you must be the owner of that property. StreetEasy may require that you provide acceptable verification of ownership (e.g., certificate of title) before you can advertise any FRBO or FSBO listing on the Services. If we cannot verify your ownership or StreetEasy receives complaints about your FRBO or FSBO listing, StreetEasy may remove the listing without prior notification, your claim on that listing, and/or suspend your owner account. Listings by owners also must comply with all other applicable terms, including the StreetEasy Advertising Terms of Service. If you are represented by an agent, you may not advertise your home on the Services as FRBO or FSBO.
- 2.2.Broker Listings: Listings Submitted by Brokerages and their Agents
- 2.2.1.License Requirement to Advertise and Claim Listings. In order for brokerages and their agents to post a listing on the Services, all listing agents must be registered with the New York Department of State Division of Licensing Services and provide StreetEasy with their full name, license number, and correct contact information. StreetEasy reserves the right to request official documents for verification purposes.
- 2.2.2.Exclusive Listings: StreetEasy only accepts listings that are exclusive or co-exclusive. Listings may only be advertised by a listing agent who is the contracted, exclusive listing agent for a listing. Multiple listing agents may be shown on a single listing, but unless permitted by this Policy, there should never be more than one copy of an active listing advertised by the same brokerage on the Services.
- Co-Exclusive Listings: The only time two copies of the same unit may be shown is when there is a legitimate co-exclusive agreement with two different brokerages. In the case of a co-exclusive listing, each brokerage will have its own separate listing for the specified unit on the Services; however, only one listing will be syndicated for display on other Zillow sites.
- Verification: StreetEasy may request documentation verifying the listing is exclusive. If you are unable to verify a listing is exclusive, we may remove the listing at any time without warning. A single unit can be advertised as for sale and for rent by the same brokerage and their agents at the same time on the Services, however, only the sale listing will syndicate to other Zillow sites. In the event the owner of a property notifies StreetEasy that the owner has withdrawn its exclusive agreement with its brokerage and entered into a new exclusive agreement with a separate brokerage, StreetEasy reserves the right to restrict advertising permissions and/or access for the property in question based on the direction of the owner.
- 2.2.3.Claimed Transactions: Transactions can only be claimed by listing agents and licensed real estate agents who actively represented the buyer in the transaction and collected commission on the transaction. If you are a listing agent on a listing and that listing closes, you will automatically be given credit for participating in that transaction. StreetEasy will not retroactively add or remove any listing agent or buyer agent from a past sell-side listing or closing record. If a broker or team lead wishes to not credit a listing agent or buyer agent for taking part in a transaction, the broker or team lead must update the listing agents and/or buyer agents that should receive credit prior to making the final status update on the closed listing. StreetEasy reserves the right to investigate reports of inaccurate claims and request documentation to confirm involvement in the claimed transaction. Repeated activity of falsely claimed transactions may result in suspension or termination of participation in the Services, including marketing programs and other programs like the StreetEasy Experts program.
- 2.2.4.Buyers Only Listings: StreetEasy may require a listing agent to provide information on gross commission, co-broke status, and co-broke percentage offered when creating a listing using the Services, but StreetEasy will not make this information visible to consumers or other industry professionals. Advertisers shall not use StreetEasy to directly or indirectly communicate cooperative offers of compensation to buyers agents.
- 2.3.Management Companies and Landlord Listings
- 2.3.1.Landlord/Management Company Information. If you are posting a listing within a building operated by a landlord, owner, or management company (“Landlord/Management Company”), you must provide the full name and correct contact information of the applicable Landlord/Management Company. StreetEasy reserves the right to request official documents for verification purposes.
- 2.3.2.License Requirement to Use Certain Services. A management company or other individual working on behalf of an owner who is not a licensed real estate agent/brokerage may only advertise a unit for sale via the StreetEasy FSBO product or a unit for rent via the StreetEasy FRBO product.
- 2.3.3.Advertising Permission for Rental Buildings. To advertise a rental listing in a building, you must obtain permission from the Landlord/Management Company of the building. StreetEasy does not accept unit level exclusive agreements for rental listings. The bullets below outline additional requirements related to advertising permissions for rental buildings.
- Landlord Priority: Landlord/Management Company can always advertise listings in buildings they have claimed and their version of any listing will always be accepted above other versions (i.e., when granting advertising permissions to a brokerage, the Landlord/Management Company still controls who can advertise a listing at a unit level).
- One Broker Policy: Landlord/Management Company can assign StreetEasy advertising rights to one brokerage, per building. Advertising permissions must remain in place for a period of at least 30 days for each building, but can stay in place for as long as the Landlord/Management Company is working with the brokerage. Any brokerage and applicable listing agent assigned by Landlord/Management Company must comply with the provisions of this Policy. In the event the assigned brokerage and applicable listing agent violates this Policy, StreetEasy will notify the Landlord/Management Company and may suspend the brokerage and applicable listing agent from advertising on StreetEasy.
- For Rent by Owner Approval: Landlord/Management Company has the right to determine whether For Rent by Owner listings may be advertised in their buildings.
- Lease Assignments and Subletting: You may not advertise lease assignments or subletting in rental buildings unless you (1) are the Landlord/Management Company or (2) are a listing agent from a brokerage with advertising permissions for the building.
- 2.4.Prohibited Listings
- 2.4.1.You cannot advertise single room offers/rooms for rent on the Services nor can you advertise short term rentals of dwellings and/or units.
- 2.4.2.You cannot advertise listings for rentals under 30 days. The lease term of any rental listing advertised on the Services must be at a minimum 30 days.
- 2.4.3.Any corporate housing providers using the Services are responsible for any licensing requirements associated with their use of the platform including a determination as to whether or not they are required to enter into an agency relationship with an outside brokerage and/or agent.
- 2.4.4.The Services are limited to residential real estate. You may not use the Services to advertise timeshares, vacation rentals, and fractional ownership properties. Any commercial properties that are listed must be clearly defined as such and must include information stating that there is potential to convert the property to a residential home.
- 2.4.5.Only one copy of a rental listing is permitted on the Services. Unless StreetEasy permits, the same unit cannot be advertised on the Services by more than one brokerage or Landlord/Management Company.
- 3.Limitations on Self Promotion and Marketing. You may not include self-promoting information or branding on listings and professional profile pages. This includes, but is not limited to, self-promotion on photos and media, in names, website URL and/or in listing descriptions. Providing direction on who to contact and how to contact them is classified as self-promotion and not permitted.
- 3.1.Photos and Video Walkthroughs. You may not include marketing information, including, without limitation, a buyer agent or listing agent’s name, company name, logo, website URL, phone number and/or email address on listing photos or in video walkthroughs, whether as text, a watermark, or otherwise.
- 3.2.Listing Descriptions. You may not include marketing information, including, without limitation, a buyer agent or listing agent’s name, phone number, website URL, and/or email address within a listing description.
- 3.3.Profile Name and Photo. You may not include contact information or any promotional or marketing information (including a phone number, email address, website URL, promotional tagline or slogan, or discount offer) in your profile photo or as part of your name as it appears in your profile and on your listings. Your name as it appears in your profile may not include titles, descriptions, or any information other than your name or your business or team name. You may not display a business or team name in your profile other than the official business or team name under which you formally provide services to consumers both on and off of the Services. Zillow may require you to provide documentation to support the foregoing.
- 4.Listing Accuracy. By utilizing StreetEasy, you represent that all information and/or data that you provide and advertise on the Services is accurate, complies with applicable laws, and verifiable. StreetEasy reserves the right to request documentation from you to corroborate the accuracy of any information and/or data posted on StreetEasy at any time.
- 4.1.Complete Data Set. StreetEasy requires a full address and accurate unit numbers. We reserve the right to seek validation that a unit number is accurate, including but not limited to compliance with the offering plan. We do not accept #VAR in lieu of real unit numbers. A complete address is required to improve transparency in the marketplace and for StreetEasy to investigate listings and maintain listing quality. If StreetEasy is unable to verify a listing, we may remove the listing at any time without warning. If you repeatedly advertise listings with inaccurate unit numbers or any other information, your StreetEasy account may be placed on probation or suspended.
- 4.2.Listing Status. It is important that the status of your listings are accurate. If your account misleads users about the status or availability of your sale or rental listing, we may prevent you from posting listings on StreetEasy.
- 4.3.Stale listings. You must verify the details for each of your sale listings on the Services every 14 days, if no updates have been made during that time. By verifying the listing, you are confirming that the listing is still available and active on the market. You can do this in the My Listings section of your StreetEasy account. Listings that remain on the market for more than 120 days, without being updated, will be considered stale and removed from StreetEasy.
- 4.4.Photographs: Photographs for all rental and sale units must be of the actual unit being advertised. In the event that photographs of the actual unit are not available, representative photos may be used under the conditions that the representative photos contain the same layout, room count, and finishes as the actual unit. The representative photos must also be of the same building address as the actual unit. Once these conditions are met, the photos may be used so long as the Listing Agent clearly and conspicuously notifies users in the listing description that the photographs in the listing are representative and not of the actual unit. Below is an example.
- Acceptable: You are advertising unit #2F but do not have unit-specific photos captured and want to use your own photos of #1F that are of the same property. If Unit #1F has the same layout, room count, and finishes, this is allowed per our Policy and must be disclosed in the listing description.
- Not Acceptable: You are advertising unit #2F but do not have unit-specific photos captured and want to use your own photos of #1R that are of the same property. If Unit #1R has a different layout, room count, and finishes, this is not allowed per our Policy and the photos cannot be used.
- 4.5.Room Counts. Only legal rooms and bedrooms as defined by Multiple Dwelling Law and Housing Maintenance Code should be included in the room and bedroom count. All units must be advertised as they exist today, not with the details associated with potential renovations. StreetEasy reserves the right to update room/bedroom count or any other feature/amenity of the listing or building referenced in the listing description or attributes if advertised incorrectly. Units with approval to be combined, but not yet combined, must be advertised using existing room counts and details. Details of potential to combine can be added to the listing description only.
- 4.6.Days on Market and Listing History: A listing must be off-market for at least 30 consecutive days before it can be re-listed and appear as a new listing on the Services. Days on Market must be an accurate reflection of how long a unit has been available. For clarity, removing a listing from the Services but continuing to publicly market the listing as defined in this Policy does not qualify as off-market. StreetEasy reserves the right to alter Days on Market if evidence exists to support this. Listing History will not be removed or altered.
- 4.6.1.Brokerage and Agent Changes: StreetEasy’s Days on Market counter will not reset if a seller changes agents or brokerages during the 30-day off-market period. StreetEasy’s Days On Market counter accrues continuously, regardless of changes in representation.
- 4.6.2.Reset Conditions: StreetEasy’s Days On Market counter will only reset after 30 full days off-market. Once this threshold is met, the listing may be re-posted and treated as new.
- 4.6.3.Accrual Conditions: StreetEasy’s Days On Market counter does not accumulate days while a listing is off-market.
- 4.7.Net Effective Rent: The price on rental listings must reflect the gross rent for the property, not net-effective rent or amortized rent. Net-effective and amortized rents will be calculated automatically when concession details are entered in the available fields in Agent Tools.
- 4.8.Occupied Units: StreetEasy requires disclosure if a for-sale unit is tenant-occupied (including partial or full occupancy). Prominent disclosure of tenant occupancy in the listing description is required to improve transparency in the marketplace and inform potential buyers of the true availability of the property. If any tenant(s) will not be moving out within 30 days from closing, this will be classed as an investment opportunity and cannot be advertised on the Services.
- 4.9.Furnished Rent: Furnished rent, as used on the Services, refers to the monthly gross rent for a furnished unit. (Price + Furnished Price = Furnished Rent)
- 5.Compliance with Fair Housing
- 5.1.You will comply with Zillow’s Good Neighbor Policy and Respectful Renting Pledge.
- 5.2.You will comply with federal, state and local fair housing laws that expressly protect individuals based on sexual orientation, gender identity and/or expression, source of income (including federal, state, or local rental-assistance programs, such as Section 8 housing choice vouchers and temporary rental assistance), veteran status, disability, marital status, or age.
- 5.3.StreetEasy reserves the right to remove any content we feel is discriminatory and/or inconsistent with our Good Neighbor Policy and Respectful Renting Pledge, and, if we deem necessary, restrict access to StreetEasy to users who violate our policies.
- 6.Enforcement. In addition to StreetEasy’s rights provided in this Policy, in the event StreetEasy discovers a violation of this Policy, any of Zillow or StreetEasy’s other terms of use or policies, or any applicable law, rule or regulation, we may remove all or certain portions of your listing(s) from the Services, terminate your account(s), and/or restrict your access to the Services. You are responsible for all activity associated with your account or your company’s account. Use of the Services is also subject to the Zillow Terms of Use and policies, including, without limitation, the Zillow Listings Quality Policy.
