Besides Mr. Hirsch, the SEC named as defendants Radical Bunny and its three other managing members: Berta Walder, Howard Walder and Harish P. Shah. Radical Bunny is in bankruptcy-court proceedings, too. The SEC suit contends that the defendants made "material misrepresentations to investors," including making false claims about how the funds would be used as well as the safety of the investments. The defendants also falsely told investors that an investment in Radical Bunny wasn't subject to securities laws "when, in fact, the Defendants received legal advice to the contrary," the suit says.
