Does anyone have a feel for wether or not buyers should agree to paying for the transfer taxes in this market? My lawyer says absolutely not, but my broker says yes.... If you have experience in this please help thanks!
I think it completely depends on the overall picture. Transfer taxes are traditionally paid by the seller. Im assuming youre purchasing in a new development if this issue has come up. It will depend on the price youre being offered on your purchase and if paying transfer taxes justifies that amount. Would you rather take a lower purchase price and pay transfer taxes or take a higher purchase price and not pay tansfer taxes. Sponsor will use that as a negotiating tool as well. Use it to negotiate but I dont think there's an answer as to whether it should be paid or not. No one wants to pay for it but does the price justify the transfer tax? sunny.hong@bankofamerica.
thanks so much! yes it is a new development.my lawyer said that in this market no buyers should be paying transfer taxes. my broker disagrees and does not want to negotiate this for me.
Tell your broker to get to work...before you switch to a broker that will fight tooth and nail for you!
do such brokers exist? do you know one? at this point it feels like my broker is on THEIR side
