Rental - Can you go month to month in NYC

Just curious, this is our first year in NY. Our lease is coming due in October. We had a one year lease agreement. 1. Do leases in NY automatically turn into month to month or you have to sign another lease. 2. Also is a month to month lease negotiable in NY or is completely unheard of. Thanks

yes, if there is no new lease signed, you turn into a month to month (assuming there is no language in your lease specifically indicating otherwise).

That's the legal position. In practice, to the best of my knowledge, it pretty much never happens in NYC. Other cities' landlords are much more flexible about month-to-month after an initial fixed lease.

tobytoby, in 1995 my landlord (a large one) agreed to renew on a month-to-month basis when we were looking to buy. i don't know if that was a huge stroke of luck or not.

We had a Two month notice clause inserted on our first renewal. I have found that Landlords dont generally mind a notice that long as they have to mitigate thier losses anyway, but from our side it limits our liability.

We're in a large building. I know one tenant on a month-to-month. I think it happens, but it's fairly rare. There's also many tenant who prefer a lease to lock in their rent. I say, No harm in asking.

As AR said, I also lived in a very large building in 2003 and the landlord agreed to a month to month as I awaited closing on my apartment. I had been in the same apartment for 12 years though, so they were going to need to do some work before re-renting.

you sure can go month to month in Manhattan. I have one now. He's a great tenant.
