Opinions on breaking lease over safety worries

I am a MR tenant and my family has been involved in a dispute over noise complaints with a downstairs neighbor. He claims my kids are making too much noise, which we obviously disagree on. Instead of airing his complaints via security or management like most NYC dwellers, he bangs on my door and screams at my wife and kindergarten age kids at my apartment only when I am conveniently not around during the day. It's gotten to the point where we have called security multiple times and even the NYPD to warn him against harrassment. Unlike the usual petty neighbor squabbles, I am actually worried about my family's physical safety now and have asked management to move us to another building in my complex to finish out the remainder of my lease. Should they refuse my request, do I have grounds to bring a suit to break my lease anyway and move out over concerns my apartment is no longer habitable for safety reasons? Any thoughts? [less]

Tommy, have you ever considered that perhaps your kids are in fact making too much noise while YOU are not around? I know exactly how kindergarten kids can be like. At a minimum, put an extra layer of rug on the floor where they normally play. Explain to your neighbor that you're trying and how you're trying instead of denying that your kids are making too much noise, because they probably are. Ask him to help you convince management improve the padding on the floor. Apologize, apologize, apologize!!!...especially if you are truly concern about your family's safety!
i agree with sunday...it happened to me yesterday...i just bought a treadmill, neighbor complained and I went and apologized.
