How to get your money back?

I'm in need of advice on how to get my security deposit and first month rent back from a landlord who promised me a 2-1-10 move in that has never materialized. The building does not have gas meters so therefore no heat or hot water. After being told that the building "will be ready next week" for almost 3 months I decided that I had enough and asked for my full refund. Unfortunately the landlord has refused to refund any amount and now I need help. What is the best way to go about getting my money back? Thanks for all your help SE!

Any advice at all? Does anyone think I have a chance of seeing this money again?

Small claims court. You can seek reimbursement of your legal fees and punitive damages of $1,000
for deceptive and/or unfair busuness practices under General Business Law section 349(h).
