Last month's rent...If you stay???

I just signed a 1 year lease {starting Aug 2010} paying first, last, and security. My lease states that tenant has paid last months rent. My question is if i decide to renew my lease does that mean that i will have to pay rent Aug 2011 and will have to wait till my last month years down the road {if I stay a long time}? My broker told me it counts towards Aug 2011 no matter what but now I'm not sure. Thanks

The terms will be governed by the lease. If the lease says you paid the last months rent, and the lease is for a fixed term ending in 12 months, then that is what happens. Your lease ends in 12 months and the last month is paid. In 12 months time a new lease may provide different terms but from what you tell us your broker is correct.

In my experience, if the landlord requested the last month's rent upfront, s/he will also request it in a renewal lease, so you generally just end up rolling it forward. You may be able to negotiate a different outcome, but I wouldn't assume the landlord will be keen to do that.

I disagree with Miette's last sentence. H0pefully after 11 months you've proven you are a quality tenant. Negotiate this back. It isn't normal, as we've discussed here on streeteasy, unless you are a special case (e.g. poor credit, foreign, etc) but again, after a year you ought to have ended those concerns with your landlord.
