Beware before you buy here: there is a tenant in the penthouse who has refused to pay maintenance for several years so we are all paying his share! We also are in a lawsuit against the builder for doing a shoddy job. Check out the financials before you buy here!

doesn't the building just put a lien against the tenant? that's what i thought.

No it's in the bylaws they can't go against him. Crazy!!!

happyny: why would you bash your own building on the internet? How does that help your situation? All I can see it doing is driving down the demand for the building and thus depressing prices for anyone who wants to sell. If the building truly has no recourse against the penthouse, a thread on a forum won't apply even a modicum of pressure. I don't get it.

i don't get it. if it's in the bylaws, then doesn't it apply to everyone, not just him?

Exactly...why don't you all not pay your maintainence...or did they make some exception to sell the penthouse? If so you all ought to sue...
