Discussion about
If one is in arrears on coop fees, has been in Court and had a judgement awarded against her, does she just get immediately evicted, like a regular rental tenant or does the apartment have to be sold and fees taken from the sale ? In other words, what is the procedure and how long does it normally take ? Anyone with info on this problem ???? Thanks You
You need a good attorney.
The particular coop's corporate by-laws are key before this question can be answered. A negotiated settlement with the coop is probably in everyone's best interests.
That depends. If she is withholding maintenence because of certain issues pertaining to the warranty of habitability, this may be justified and eviction impossible. If the coop cures the issues that are voiding the warranty of habitability and quiet enjoyment of the apartment, then you may be able to collect future maintenence.
