We saw an apartment today at Glenwood and we were told that if we have my husband's nine year old with us, then Glenwood won't give us the 1 bdrm, they would want us to move to a bigger apartment. Obviously we all know tons of families that do have a 1 bedroom with a kid or kids. Is this legal?

Don't know if they do, but what if they have a written policy that limits the number of occupants per 1 bedroom?
I think Sunday is likely more correct. I could EASILY see a building saying no more than 2 people in a 1 bedroom, regardless of the age of occupants.

Not a "parent", but parents, so it's not 2 people, it's 3.
There is housing code that defines minimum living space/person (person being anyone over the age of 4).

BTW, I didn't mean to suggest that the policy is illegal. I was just posting info about the relevant laws. They may or may not apply here, depending on what the policy is and whether it really discriminates against families with children.
They aren't discriminating against families with children. They were happy to have the family there, just in an appropriate sized apartment. They are discriminating against slums.
If you can afford the rent in a glen wood building (which are high-end one bedrooms) why are you trying to put 3 people in a 1 bedroom. Get a two bedroom from a different management company. I can see if the kid were a few months old but its weird (and a little creepy) to have a nine year old sharing a bedroom with his/her parents.

Do you have the 9-YO visiting -- i.e., your husband's custody arrangement -- or do you have the 9-YO living with you?
There are two enforcements of Fair Housing, but the easiest is to call 311, which will hook you up with the relevant agencies.
NYC takes Fair Housing very, very seriously. They'll be able to tell you pretty quickly whether this is a violation or not.
