Holding deposit for rental

I am a landlord and the deal just fall apart. Can I keep the deposit paid in advance of signing the lease? It was to be applied to the 1st month rent upon signing the lease. What is the norm on holding deposit or pre-sign deposit? What is market practice? Anyone has experience with holding deposit dispute?
