It's a difficult and time-consuming process, but it can be done. Make sure you have your lawyers involved every step of the way.

A friend of mine was on the board of her old building when they had to get rid of an owner who had severe mental health issues. But she was also in arrears so it became a financial more than "good of the building" issue at least on the record. I think you have an easier case if the maintenance payments are not being paid. If they are and there is some kind of separation/divorce agreement in force I would start with the wife's attorney and explain the situation to her since it's the wife's property.
Regardless, I know a great real estate attorney. I don't know if she handles these types of things but I would absolutely trust anyone she recommends. Fern Schwaber (212) 643-9140.

Gee, this sounds all too similar to a scenario we had in our UWS condo. The wife was an attorney and the "husband" was a real troublemaker. Found out they weren't married and had defaulted on property in Florida, in addition to the NY condo mortgage and maintenance. Two lawsuits and three years later they were evicted by the mortgage lender, who actually ended up taking the place to live in. We went through several lawyers and it cost the building almost as much in legal fees as we collected the first time around. Still waiting for $$ from the second suit. Good luck getting the out and getting paid!

Lol. Yeah i'm sure it will be neither fun nor easy. Wouldn't bother if he didn't pose a serious threat to the safety and peace of the building. The wife is the submissive sort, but she has all the money and the property, although i think all of that was on daddy's dime anyway. Should be interesting. Will keep you posted.
