Tax Abatement Respond Letter for 421A??

Little confusion as my mgmt company just sent a letter saying I have to respond and mail back to Maywood NJ by this April otherwise City may stop our abatement.. I live in new construction and already have the 421 abatement so not sure why I even got this letter from mgmt cause I thought we could only have either or...it's probably just a standard CYA letter from mgmt as they oversea multiple types of buildings.. .. since Im already 421 should I even bother filling out primary condo abatement paperwork or will City automatically know Im in 421 (different abatement) and not do anything? thanks

I would fill it out. I think the City is trying to establish a comprehensive database of who has what type of tax abatement.

This issue of primary residence and tax abatement does NOT apply to 421a new construction tax abatements already in place. Is that correct?

Your management company has the wrong information and should not have sent that letter if your building/the units qualify under the 421A exemption program. And here's why: Abatements operate by applying credits against taxes as opposed to exemptions that jimmy with the building/unit's asessed values for a length of time....although repeatedly described incorrectly, the 421A is an exemption program not an abatement program. The changes in the law currently affect only the abatement programs and not any exemption programs....

"Exemptions
Exemptions lower the amount of tax you owe by reducing your property's assessed value.

Abatements
Abatements reduce your taxes by applying credits to the amount of taxes you owe."

also go here https://a836-propertyportal.nyc.gov/Default.aspx and type in your address. it will confirm whether you fall under the 421A exemption program or one of the other abatement programs.

i wouldn't fill it out and I'd educate the management company then send them an invoice for your time that you did their work for them.
