splitting shares

My residential share holding includes a lower level studio, designated on the CofO as commercial. I was told the only way to separate that as a separated share holding that oould be sold off would be a change in the C of O to allow it to be a residential unit. Separating it as a separate commercial unit was not possible. Any counter opinion ?
