Sidewalk shed obstructing my living room

Quick request, my neighbour has set up a sidewalk shed along his properties. His demolition permit is not yet approved. However, when I came back to my apartment on the second floor of my 6-stories building, I discover that the sidewalk shed was covering more than 10 feet into my building, obstructing half of my living room windows. I know the rule is “Along property line and 20 feet into adjacent properties at buildings higher than 100 feet”: But with a $ 4,650.00 monthly rent, I have no intention to endure this annoyance, but I don’t want to face the hassle of moving to another place. What are my options?

Think of the expense you'll save on room darkening shades. With the rent you're paying, that's an additional cost you don't need.

Well now look here, an actual, LEGITIMATE complaint about something being outside their building.

Have you tried to contact the owner of this structure? If it's on his property and not breaking any rules, you might be out of luck, and at just have to appeal to his nice side.

seems to me you have no legit beef at all.
neighboring owner has put up a sidewalk shed in compliance with city construction safety specs.

and as a renter, were you to have a legit beef, it would be with your LL, not the neighbor.

I have filed a complain at 311. My neighbour is allowed to extend the sidewalk to adjacent properties up to 5 feet for a building less than 100 feet, and up to 20 feet for a building higher than 100 feet.

My landlord has not been helpful. His concerns lasted pretty much for one day. Now he doesn’t care.

Should I ask him to lower my rent because of this or should I ask the neighbour to compensate for this annoyance? What do you think and how to do it ?

You can call the District Manager of your Community Board. He or she may be able to help.

if the neighbor doesn't do anything, that's my expectation, then you need to do a review of your lease. there should be some statements about depleted services or something to that nature. it is definitely not a warranty of habitability issue.

because you're paying so much for rent, after you've reviewed your lease, you can speak to the landlord. if he is not interested in assisting, contact an attorney and see if you can/should get a discount on rent. then withhold that portion of the rent after providing a letter from the attorney.

i would stop paying rent and find a new place to live, after serving the LL a notice.

When your lease is up, you can either move or negotiate a lower rent with the landlord.

An obstructed view wouldn't be held to justify your breaking the current lease.

If you're going to agonize about it or "not intend to endure it" (the landlord's still giggling over that one) then you could spend a few hundred bucks to have someone you trust tell you the same thing. Ending with "sometimes bad things happen and there's nobody to blame."

There must be a reason for the city to allow your neighbor to do what he is doing. That probably includes the assumption that 1. They need that much room to work, and 2. The inconvenience to others should be within tolerable limits. Think about all the constructions on the road and within the subway system. You cannot simply jump the turnstile or not pay your registration fee because you think you were receiving less service than you expected (even after you sent an attorney letter to the MTA or the DOT). If no one is breaking the law, then it is the things that we need to tolerate living in this modern world.

The city doesn't "allow" you to extend your sidewalk shed 10 or 20 feet in front of neighboring properties, it requires it for most types of construction that require sidewalk sheds. Your neighbor would probably just as soon not be spending extra for 20 extra feet of sidewalk shed, but it's a DOB requirement. The only party you might have recourse against is your landlord, and then only if your lease specifically mentions this eventuality. Assuming it doesn't, you're unfortunately SOL.

ANYway, getting back onto the subject, herbert73, I agree with ab_11218 on this one. Definitely depleted (or reduced, the lease sometimes indicates) services, not not a habitability issue, which is defined by law.

If all that fails, you must consider the cost of an attorney vs. how much you like living where you are now, and see which situation best fits your needs.

I would like to thank most of your responses. I was walking in Sutton Place today and saw that some sidewalk shed have mesh panels instead of wood panels, this would allow us to keep the light coming through the window while keeping things safe for the pedestrians. I will propose this to XXX scaffold Inc and see what they say.

herbert73: Yes, that would be a practical option to resolving the issue.
At least you will be contacting the actual "owner of the structure" to suggest a possible remedy.

The proof is on these streeteasy discussion thread comments, wherein I get along just fine with many others who actually listen to what I have to say and "Unignore" my comments. They don't insult me and we get along on streeteasy. It's their choice to do so.

Sheds are structures. In this case, its owned by someone. Truth: fail.
This shed is along the neighbor's property (see OP). Truth: fail.
You getting schooled is something easy and apparent, not needing anyone else's intervention.

Sillysonya and trollalanhart had a good time last night while making fools of themselves.
Just another fun Friday night in NYC, wasted in front of their computers with nothing else to do.
sillysonya writes that I have " wonderful "chats" on se (that nobody sees.) "

Back to Herbert: Since he would be O.K. with the wood panels being replaced by mesh panels, he's now going to propose that to the scaffold company (the owner of the shed). He will then find out if such a replacement is
possible and if so, the cost of the replacement.
Then Herbert can contact his landlord to see if his landlord will pay for the replacement or reimburse/reduce Herbert's rent for him paying for it to be replaced.

If Herbert's landlord refuses, then NWT's comment describes the eventual outcome.

I have tried to contact the owner of the sidewalk shed several times, but no luck, got the voicemail each time. I have ask my landlord to do it on our behalf, and told me that he will do so, so I keep my fingers crossed.
