Common Charges Balcony/Terrace

I own in a condo building and have been unable to use my terrace as a result of city mandated work. As a outdoor space owner I am responsible for a greater common charge than those without. I was wondering if there was any precedent from other buildings in place for common charge reduction when outdoor space is unusable?

Terrace is a touchy subject around here.

How long are you unable to use your terrace?

Terrace has been closed since December...they've been doing work on the building for a more than a year

Your building? Why should the other owners bare the burden for the same unusable terrace. It's not the building's fault.

That leaves the city. I suppose you could fight to have a reduction of the taxes. If you actually won you'd spend more on the lawyer. Terraces are a luxury.

The "extra" you pay is for "owning" the extra. "Use" of the extra is secondary. And at least it sounds temporary.

How about those who pay an "extra" amount because of a units view, only to have a new higher building built in front of it. I imagine some of those owners would like a rebate on their purchase price.

Sorry if my comments are somewhat cold, I imagine it's annoying not to be able to use your outdoor space as it's getting warmer.
I'd at least get involoved at a board meeting and find out the exact nature of the work, the timetables,etc., and sit on everyone to make sure it's not dragging.

Your condo's declaration and by-laws give the condo access to limited common elements (e.g. your terrace) in order to carry out repairs, with no reduction in common charges.

You might want to read yours, just on the slim chance that they're different.
