Discussion about
If you realize after your closing that your lawyer screwed up on a few items or did not inform you of important information about the property (I was the buyer)....is it possible to take legal action against them?
Sure, you can sue. There are attorneys who specialize in attorney malpractice cases.
Thanks fieldschester....can you recommend any malpractice lawyers?
Also, I thought I should run this by another real estate lawyer first to make sure we are correct in finding fault with our lawyer....can anyone recommend someone?
Thanks.
How were you damaged? In what way(s) do you hope to recover?
The main things were that lawyer did not tell us that the previous owners did their renovation without the proper permits, and actually withdrew their application with the DOB during the closing process. He also did not tell us that the property is classified differently by department of finance vs. DOB vs. HPD. We have found all this out after the fact by our contractor who is familiar with all of these websites and pointed this information out to us as he could tell that some of the renovations were not done properly and were therefore probably not signed off on.
Needless to say, the inspector missed a lot of things as well, and guess what....the inspector was recommended by the lawyer!!!! But I have heard you cannot sue a home inspector since they put a lot of disclaimers in their home inspection report.
How much will this cost you?
The things that the inspector missed....probably $25-30K so far.
The paperwork stuff I have no idea....I don't know even where to start with that.
Just on the chance you find it not worthwhile to sue the lawyer, try http://www.courts.state.ny.us/ip/attorneygrievance/complaints.shtml
Can anyone recommend a good lawyer that can advise me on this? Either a real estate lawyer or a malpractice lawyer is fine.
fieldchester, huntersburg & hfscomm1. they're in the book.
Do people know if the home inspector who missed many things can be sued? (Despite his disclaimers in the inspection report)
Sue me! Sue you! Sue everyone!!!!!
Brooks2, you could be a songwriter.
scarednycgal - Consistent with the responses on both threads with this title, I cannot imagine the litigation you contemplate being cost-effective for you or for any attorney who might work on contingency even if litigation had high probability of success. Incredibly frustrating for sure, but as with so many things, you have to hope that your diligence in vetting service provider on front-end saves you from major headache on the back-end. Sorry for your experience.
