Rogue Co-Op Board Help!

Hello! Has anyone had experience with their Co-op board deciding on a back garden renovation without consulting the share holders, and particularly the apartments that directly face the back? Our board is planning on installing a permanent grill outside our bedroom window and construct a very high fence that will likely obstruct the minimal daylight we get. Is this legal? Help! We're excited to have a garden but very frustrated that they've made these decisions without consideration for the tenants who will be negatively affected by the overly ambitious plans... Anyone with information on protecting co-op shareholders rights would be much appreciated. Best, M

Wow .. sorry but I think you're SOL. You knew that going into a co-op purchase that they would have dictatorial power. They're the board of directors, it's their building, they can do what they want basically. Terrifying.

Is there a flip tax? Is it a HDFC? If you can get out without being punished too badly, maybe now is a time to consider...

Hire a lawyer to show detriments to habitability of apartment and impact on future sales price of apartment. You would be better if you had other neighbors also affected who would join in hiring a lawyer. Your only other choice is to keep on calling the fire department. They are VERY strict regulations about grills in apartment houses.

Hire a lawyer or better yet, get others also affected to go with you on the lawyer. They are negatively impacting the habitability of your apartment and your future resale value. If you don't want to go that route, call the Fire Deparment. They are EXTREMELY strict rules about using grills in an apartment house.

Hire a lawyer and get others affected to go in with you on this. They are negatively impacting the habitability of your apartment and future resale value. If you don't want to go that route, your only recourse is to call the FDNY. They are EXTREMELY strict regulations about grills in an apartment house.

Very bold move without consulting shareholders directly effected by the changes. Building a BBQ for building use outside a bedroom window without consulting you is a problem. Such changes could have considerable impact on the resale value of you apartment. This is definitely a job for an attorney. Start this process ASAP. Coop boards are seldom interested in legal fights of this sort with shareholders. If the enhancement of a building is going to come at your expense then you have a good chance of putting the kabash on the BBQ.
