creaky floors and uncooperative neighbor

Hi all, We recently bought a coop in Brooklyn and moved in. The neighbor above is a tenant. The bldg has higher ratio of tenants and they recently placed restriction on subletting. We are hearing creaky noises (loud metallic squeaking) when they walk upstairs and we spoke to the neighbor who first was not very cooperative but then offered us access to his place to demonstrate it is in floors. Most co-ops require 80% carpet/rug with some sort of noise reduction padding. You should read the house rules and ask the mgmt company to enforce the rule.

The tenant doesn't care because he/she is only renting but the penalty of not following the rule will impact the owner, which may flow through to the tenant. I recall signing the lease that had language to comply with house rules when I rented a while back. I was subject to pay the penalty of violation.

Many co-ops require the party complaining to also have 80% carpeting.

Non-purchasing Statutory Tenants are not bound by the Coop's Bylaws, but by the terms of their Statutory Lease. Of course, those call for 80% of floors to be carpeted.

Condos also frequently technically require owners to have 80% carpeted. However, in practice no one really enforces this. Especially if you are reasonable and can talk to your neighbors. If you have someone who likes to fight, only then may you have to deal w this in a condo especially.

Honestly I'm not too sure how well carpets help. If your neighbor is having a party or just playing a loud movie the sound and especially the base will always come through the floorboards. The only solution I've found is to have your neighbor's cell and just text them. If no luck, I've literally went to their door even at 4am in my bathroom and knocked. Confronting someone in person always does the trick :-)
