Question re $8,000 tax credit

So i make too much money to qualify for the $8,000 credit, but my fiance does not. My question is, if she closes on an apartment before we actually get married in order to get the $8,000 credit, can the gov't ask for it back after we get married?

If buying together unmarried, then the one whose income qualifies can take the whole credit. If buying while married, it's the joint that counts. Don't know about your timing issue, but there's quite a bit of info at irs.gov that might clarify.

I just spoke to someone on this topic and you can get the $8K by adjusting your 2008 tax return. As long as you close before you're married, you should be fine.

I think you also have to think of timing of wedding: if she buys and you get married in the same year, I believe she won't qualify, even you file separately. But if she closes this year and you get married next year, I think she will.

If its a co-op and she makes under 75k, its possible the co-op may reject her alone. If you both go in together to satisfy the co-op they might insist that you BOTH be on the mortgage. Not sure how this affects the 8k credit.

Bugelrex - good point. What if her parents are willing to guarantee the loan? How do co-ops boards usually re-act to that?
