Need advice on this listing

I was interested in getting information on an apartment I saw in the NY post http://www.nypost.com/realestate/houses_of_the_week.htm and my friend referred me to this site for further research and advice. Any thoughts?

Biggest red flag, IMO, is that there has never been a $1MM+ sale in the building.

I've actually since this apartment. Broker told me it's one of the largest in the buildings. Loved the place but they wouldn't have my dog. Love me, love my dog.

Can this apartment be legally listed as a 2-bedroom? The "bedroom" downstairs has no window (unless they're counting the windowed walk-in closet as a bedroom). Also, although the floor plan shows the upstairs "bedroom" (really an open loft space) to have a window, I don't see it in the picture (unless that light coming from next to the far bedside table is technically a window).

OTM - Haha....yes, the new fad in apartments is having windows in your closets!

OnTheMove – there is a window upstairs and there was one in the bedroom downstairs that was replaced by previous owners by a mammoth AC unit that is not being used because it would freeze these people’s kids apparently. I would’ve reinstated that one and also possibly made the bedroom bigger to incorporate the walk-in closet. I actually spent quite some time looking at the place because the dog thing didn’t come up right away. I guess there is some value to having a broker represent you… (I went to an open house.)
