Landlord in another country

If I wanted to take a landlord to court in NY but he resides in another country, how could this be done?

As long as he has property (property being an apartment or even bank account) in New York City, you can sue.

Which address would I use in filing? Should it be for NY or the foreign country? I am asking because I think he has the rental property listed on his bank account.

If the mail goes to his rental property (which I live in), he wont get the notice I am assuming.

Doesn't he have a property manager? Why do you want to sue him?

A friend of mine having issues with landlord who is refusing to fix anything, allowing people to go to the unit looking with out permission and trying to cancel the contract with out cause because he refused to a rent increase in the middle of the lease. The landlord just says, he live in another country so there is nothing that the renter can do about it (he used to reside in NY and the rent goes to his NY account).

He moved out due to canceled contract and he wont return the deposit because the contract was cancelled. The landlord rational was the the renter didnt agree to provisions so the contract had to be cancelled and it is the renter's fault. He is trying to figure out how to at least get the deposit back.

My claim is not based around service / maintenance. The landlord is simply refusing to return the deposit back to me after I have moved out claiming that there were damages. I took photos for proof and about to figure out who or how to file a claim to get it back.

should've done the old.... keep my deposit as 12month payment gig.... I always do.. it makes the owner come looking for me not the other way around (only true on a one man shop basis, a professional mgmt co. would've come in signed off and/or they know how to deal w/ mold and won't charge you $500 to recaulk)... IMHO.

What a surprise. w67thstreet, the commercial landlord, former residential landlord, admitted litigant in a large number of past and present lawsuits against his tenants, and current renter tells you how he has cheated his landlord.

ps mimi, do you condone cheating property owners or do you support property owners? how would w67thstreet fit in to your morality given he is a property owner who cheats other property owners?

i agree.. i've always used my deposit as last month's rent. it makes my life easier and ll's more difficult.

How could it possibly be cheating the landlord, assuming the security deposit is a full month's rent? The rent was paid for the first 11 out of 12 months. It's not like it's a cleaning deposit. Everyone I know does it that way, and when I had tenants I told them to handle the last month that way. Duh.

nooooo alan, no one does it that way...anymore...perhaps in 1984 or so? try getting a landlord to do it now and see what happens. it is a security deposit, not your rent check
