We've been in the building for 16 years and want to swap our 1 bedroom for an available 2 bedroom which our super showed us 2 weeks ago. The super told us that the landlord won't let us swap. Charles H. Greenthal, the management company, told us that someone already put in an application on July 26 for the apartment we saw on July 11. The super showed it to us. Can we do anything to prevent it getting rented out from under us?
The super has nothing to do with the rental. You should have contacted the management company on 7/11.
Correction - the super showed us the apartment on July 10. I called the management company on July 11 and, per their instructions, faxed them a request to rent the apartment. Today, they claimed that the fax "fell through the cracks." Meanwhile, the fax also had a request for a rent extension which the quickly followed up on by immediately sending out a contract.
p.s. It is common knowledge that our super has asked prospective tenants for money upfront to him.
I would ask the management company what it would take to rent this apt to you. When I rented my apt the management co asked for/demanded a 5% fee in addition to the 15% fee due to my broker (this additional payment is also referred to as "key money" and I believe is illegal - did not know this at the time) - I begrudgingly paid it as I really wanted the apt - turned out to be a great deal for me as I stayed in the apt 9 years at a very attractive rent; so, it can be a dirty business and I can't stand the management co I deal with, though do what's best for you - if you really want the place, find out what it would take to get it.
