The Real Deal is reporting this. Can this happen...does somebody finally have the gumption to stop Extell's madness?
Well, it looks like Extell's end run around the legal system might be coming to an end. But in the end, they succeeded if their ultimate plan was to hold on to the "sales" and the deposits until the market improved. This long legal battle has afforded them time to make many more sales albeit at a discount to their reputation. It will be interesting to see if it was worth it to face off with Andrew Cuomo. I guess we will be able to gage that outcome by the amount of political donations Barnett/Extell /CRP make to the governor in the coming years.
sad but true apt 23...but has the market really changed for them. And how are the sales at the Rushmore?
It can certainly happen. It's going to up to the judge, he can permit Extel's 78 to continue or agree with NY State A.G. position and dismiss.
3 potential outcomes it seems: case dismissed and money is returned, case not dismissed, but no stay and money is returned, or stay is issued and case whether ruling is arbitrary and capricious is heard. Don't like those odds if I'm Extell, since TWO federal courts have already ruled for no stay, and have dismissed the case. Hard to see a state court ruling differently from two federal courts that ruled basically right away and unanimously that there are no merits to their claim. Hey, at least Edward Norman got his $1000/hr from Extell for 6 months!
