Discussion about
http://a836-acris.nyc.gov/Scripts/DocSearch.dll/ViewImage?Doc_ID=2010110101080001 I guess the Rushmore lawsuit is not leverage here. Interesting offering plan for those that read prospectuses.

It's the condo declaration, not the offering plan.

For now the building isn't split into saleable units. The declaration will be amended later to divvy up the single large Tower Unit (11th floor and up,) as the developer gauges what size apartments buyers want. (Assuming there's any interest at all....)

Anyone know if there is precedent or how common it is for the A.G. to issue a no-action letter allowing the condo declaration and then not proceeding with an offering plan?
