233 east 69th st lawsuit with MTA

Right, buyers ain't too bright sometimes. "Nobody will ever build there."

They're the B, H and I lines. All the affected rooms have other windows facing away from the MTA's lot. See http://www.columbia.edu/cgi-bin/dlo?obj=ldpd_YR_0377_MH_001_003&size=large

It'll affect those lines' value to the extent they rely on those little lot-line windows. If the co-op got suckered into paying for the lawyers, then all the owners will suffer for the B/H/I idiots.

I'll all for protecting one's legal rights, os if the suit has merit, it should of course proceed, but related to this, can't help think this is one reason why nothing gets done in New York anymore.

Oh the pain of lost light in NYC.
One of the great punishments of the lot line window.
I've seen worse at the Hampton house on the corner of 79th and 1st.
Insult to injury...it's ventilation shafts and water towers.
Few New Yorkers appreciate the prisoners of Second Avenue.
They have taken one fore the team.

With the Post to whine for them.

Turns out, the story's a year old, and nobody sued the MTA. Looks as if somebody said "Hey, I know somebody at the Post, and maybe if they raise a stink the MTA will change its plans."

Thanks, johnval. I was looking in NYS Supreme Court, assuming the MTA was the defendant. But since the US DOT is a defendant, it's federal court.

I hope that co-op has plenty of money set aside for this.

So would this turn you off to looking at any apartments in this building due to future financial implications? My concern would be for the maintenance increasing assuming they are paying the legal bills...otherwise I'll look elsewhere.

The co-op seems to have accepted that they're going to have that thing on the corner, but are fighting the details. The question is their likelihood of success, and whether they can get the MTA to cover their costs if they win. I'd say zip and zip, but that might be too cynical. What's really bothersome is that all the shareholders are paying for something that impacts only a few.

Buildings like this are dime-a-dozen in the neighborhood, so I'd go for one without issues.

FYI- the lawsuit was dropped and is no longer an expense to the building from what I can gather. Muckhouse removal and completion of building next door are scheduled to be completed within 12-18 months. Hope the update helps.
