Disgruntled Northside Piers Buyers Declare War on Toll Brothers Thursday, March 24, 2011, by Joey Arak Ever since buyers began moving into the first Northside Piers tower back in 2008, complaints about the construction quality of the Williamsburg waterfront condo complex (which now includes two towers with a third to come, eventually) have popped up on message board threads and in the occasional blog post. But now irate Northside Piers residents are taking things a step further. It seems they have launched a full-on media offensive. Two articles have just been published documenting a laundry list of complaints about the Toll Brothers-developed towers, including shoddy workmanship and Bianca Jagger's worst enemy, mold. Strap on a surgical mask, because we're diving in! Outlet: New York Post Headline: Williamsburg waterfront condo residents complain of 'shoddy' construction Complaints: leaky walls, poor insulation, mold, faulty plumping, faulty sewage system, faulty heating, faulty air-conditioning. And the biggest: "The windows are thin and the seams between the panes allow wind and rain to easily come through, residents say. Some residents have taped around the window panes, but they say rain and air still blows in." Best resident quote: "We were promised luxury living if we came across the River from Manhattan to be part of the resurgence of North Brooklyn. I was not expecting such shameful and shoddy workmanship." Toll Bros. response: The company "is aware of these isolated situations and strongly disagrees with the allegations as they have been presented. It "will continue to honor its obligations and provide the quality and customer service for which it is known." Now on to Northside Piers Takedown II, which is written by Williamsburg activist Phil DePaolo, who is quoted as a source in Northside Piers Takedown I. Outlet: Williamsburg Greenpoint News + Arts Headline: Luxury Living is Taking a Toll, Brother! Complaints: Non-union labor, leaks, those darn windows, outrageous utility bills because of those darn windows, "shit" floors, floods, mold, mildew and some sort of wide-ranging conspiracy between Toll Brothers and the property manager to engage in "bad faith, criminal negligence, and blatant disregard for the health and safety of residents and the public." Oh, and "The Board conducted a questionnaire and as many as 88 owners have some form of complaint regarding their units." Best resident quote: "I’d be happy if I didn’t hear my neighbors. I was told that what I was describing should not be the case. I’m not an expert, but this leads me to believe the wall is defective. I’m certainly not tearing down the wall and fixing this with my own dollars." Toll Bros. response: "The Board apparently had a meeting with Toll Brothers this past Tuesday. They claimed Toll Brothers have 'changed their tune.' It seems during the meeting, Toll Brothers recognized that all the complaints are not isolated incidents, and are serious problems. They claim that Toll Brothers have agreed to remedy the complaints, not just with quick fixes." There's even a Martin Act mention, which usually means one thing: Here comes a lawsuit! Any Northside Piers residents out there want to back up or refute these claims? Especially this guy. Toll Brothers considers "shoddy" to be a business practice. They always have, they always will. There are complaints throughout the US and going back many years about Toll.

The only one worse is Pulte. Friends of ours had a Pulte in FL, and their windows literally fell out. Their neighbors windows fell out. It was pretty amusing.

At One Main the very soldid group of Board of Members who negotiated a settlement with David Walentas, One Main developer, worth in excess of $1,000,000.00 to settle claim the owners had against him arising out of defective construction. The lawsuits had been waged in both State Supreme Court as well as the Attorney General's office for several years prior Board spent a very large sum of money on engineers and attorneys. The lead negotiator was a owner, a brilliant District Attorney General for several years prior Board spent a very large sum of money on engineers and attorneys. The owner, a District Attorney, was the lead negotiator with Amish Patel, Walenta's representative. One Main received $700,000.00 in cash, and Walentas did repairs worth in excess of $300,000.00, as well as turned over to the owners a Hugh physical space they used for a new storage space room and bike storage. The building turned from one with no financial reserve and serious leaks, to a financially and physically healthy building. Sales had been practically frozen during the pending litigation, and they resumed robustly once the settlement could be reach. Hence why should anyone listen to your off-putting post and officious statement. You obviously don't know how to proceed with helping yourself or neighbors.

To the members of the Board,
This letter is a formal communication to the Board and all shareholders of the Northside Piers Condominium Tower 1. At this time, it appears that certain aspects of the buildings problems may fall under the jurisdiction of the New York State Attorney General’s office. The following summarizes many of the outstanding issues, prior to the soon to be released engineer’s report, that may warrant the AG’s office taking up our case against the sponsor, Toll Brother’s. The issues laid forth here are not warranty issues and thus appear to violate the AG’s standards for determining if a condominium’s prospectus can be certified. For example:
1. Although the prospectus appears to be silent on flooring, the sponsor clearly advertised hardwood flooring and provided engineered wood that certainly is not equal to hardwood flooring.
2. Certification in the prospectus denotes that the sponsor has built to code. This is not the case, as there appears to be a lack of insulation throughout the building.
3. The windows were supposed to be engineered to the type and location of the project. The windows have caused widespread problems regarding air and water infiltration and no remedy, to date, has been forthcoming.
4. The prospectus, to the best of my knowledge and belief, was to contain a B1 schedule of individual unit’s monthly projected electrical bills, which include both heating and cooling. The B1 schedule was missing and thereby failed to properly inform prospective shareholders of the utility costs that they may incur.
5. There also appears to be issues with the design, installation, and/or function of the bathroom duct system. There seems to be poor motility, as air is not being sufficiently pulled into the duct system. This is resulting in excessive dust and condensation in the bathroom area and thus raises the specter, over time, of mold growth. Was this issue investigated by the engineers report? Are all aspects of the ducting system and fans, throughout the building, up to code?
6. Both the tower and townhouse foundations have groundwater issues that are of a continuing nature and were not an issue expected by the buyer. Has the Board put the sponsor on notice for capital funding for the perpetual containment of this issue?
7. In regard to the heating and cooling system, it appears that HVAC units have been unnecessarily burdened by the simple fact that the building’s plumbing is not chilling or warming the water. This causes the HVAC’s to perform double-time to perform the utility that they are intended for. This unnecessarily raises heating/cooling costs and will wear out the HVAC’s in a more expeditious manner. According to ConEd, across the board, homeowners in this building are paying excessive rates for utility services. Has the engineers report investigated this issue? Furthermore, regarding HVAC’S, certain homes were promised in the prospectus more units then what was given. This appears to be a deceptive practice that must be further investigated.
8. Although the building is only a few years old, the exterior cladding is already coming off and appears to be the result of inferior materials and/or workmanship. Also, regarding the façade, statements were made by Clearview Windows, which implicated the sponsor with poor construction of the building. Mr. Sturbridge stated that due to poorly formed concrete slabs, grinders and sledgehammers were needed to get the frames in and thus the buildings frames are out of square. This he states further compromises the functioning of the encased windows and overall air and water infiltration. Has the Board put the sponsor on notice for this issue and has the Board requested future capital funding for the repair and replacement of the substandard work and/or materials?
9. It is common knowledge that the building’s plumbing system has incurred numerous leaks and floods due apparently from faulty construction. Water damage has already caused mold problems in a number of units in both the tower and townhouses. Has the Board put the sponsor on notice for this issue and has the Board requested future capital funding in order to address this hidden, but lurking problem?
These and other issues, that may have been omitted or vary to a significant degree from the report filed with the AG’s office, will need to be directly addressed. Therefore, I am respectfully requesting, in writing, an acknowledgement of each of the heretofore-stated issues.

I know nothing about this particular building or the company that built it, but let's just be clear that during the recent real estate boom, there was an orgy of building going on in NYC, and much of it was done by less than reputable contractors hiring less than reputable subcontractors who paid people as little in wages as possible and not surprisingly the money saved in wages has now been passed on to the suckers who bought these condos who will need to pay to have the shoddy work fixed. The developers and contractors made a nice profit, the apartments were sold at ridiculous prices, some families in Mexico got some remittances sent home from their relatives, and we will be reading stores about bad construction for years to come. Greed kills.

@guest #50: What is difficult to understand is how or why Toll Brothers permitted this to happen in the first place as the company, to protect itself from lawsuits and its integrity should not have permitted this type of construction negligence to begin with, as every step in the construction should have been supervised and signed by the contractor responsible for adhering to the architectural drawings and their specifications and then the permits for the same. How can anyone be that stupid and reckless, especially as the buildings have prominence over the area in which they are located?
Looks as if everyone with a problem with his condo or building riddled with violations has better wake up and start filing their individual "NEW YORK ATTONEY GENERAL COMPLAINTS and lawsuits - and that means start NOW!!! BOARD members need to complied to protect "all" owners interest. Water, air, blowing out windows, boiler room was being used for storage, electrical extension cord through a handicap (Accessble Lift) to light a Christmas Tree, CGI water prevented Long Island City Company "waterproofing each individual's owner storage unit" giving a two year warranty for joist water and ground water infitration. The entire building can be condemned. Get more information on this to the "NEW YORK CITY ATTORNEY GENERAL;

You may have some good points listed in your never ending posts, and if you are looking for advice or support, you could have found it here, however your delivery is suboptimal at best.

Your hostile shows a break in your personality. Yes, you do need a license for any type of diagnosis. Check with your health care provider. It's obvious your have a meltdown on legitimate issues that affect Northside Piers Tower I, 164 Kent Avenue, LLC. In life you never suspect anything but I understand you do. Your officious word usage suboptimal describes your posts. You use the adjective f* as it's in your vocabulary not mine. It's usage clearly denotes your agitated. Why? There was no ranting post but facts. Facts that a Toll Brothers employee such as Senior VP David Von Speckelsen, Senior VP Assistant Scott J. Arvam, Project Managers, Adam Gotlieb, Joe Fuentas (who does use the word rant) Mark Cordasco or the Sales Manager Teresa Ali.
