Is my coop required to notify me of construction of the apartment under me? When it is scheduled? How long it will last? And what are my rights if I have not been notified - can I withhold my monthly maitenance?
The coop is not required to inform you of construction, but the work hours, protection and clean up must comply whatever is stated in the house rules. It would have been a neighborly gesture to have been informed of the construction in advance by your neighbors. As long as they do not breach whatever is stated in the house rules, you don't have any rights as far as I know.
It would have been neighborly of them to let you know in advance. However given that your initial reaction to the construction is to try and squirrel out of paying maintenance (wtf), I can't say I blame them. You sound like the type who will go out of your way to impede their work and make life difficult.
Some people do not know that work performed in their apartment would have a negative effect on the neighbor upstairs. Some buildings require the owner to send letters to the neighbors on the same floor as well as under them.
