We put a bid in that was accepted on a short sale and were approved for a loan. We discussed with the seller's agent, Mic Murphy, that we needed to use FHA financing. He assured us that this was fine and said "you are my buyer". After being told we would have 2-3 months for the short sale to close and that FHA financing would be completely fine, we paid $$ to obtain condo information and have the place approved for FHA financing. Then, the seller's agent - Mic Murphy - suddenly stopped returning our calls. He said he sent a contract to our attorney but she never received it. After many ignored requests to move forward with the transaciton and provide a contract to our attorney, the property was listed as "in contract," with another party. We are out money and a LOT of time that we can't get back and no small amount of effort and frustration. Mic Murphy thoroughly demonstrated that he is not trustworthy. [less]
So basically you are an idiot. In that perspective, when you say you are out a lot of time, how much do you believe that an idiot's time is worth?
Also, what money did you spend? How much "$$" was the "condo information"? Two hundred?
Stop your whining. You acknowledged in your second sentence that Mic was the seller's agent, not yours.
Waaaaah, I spent a lot of time. Now I'm going to spend even more time seeking revenge, even though this time, like the prior time, will offer no return to me. Waaaah.
Two lessons:
Get a broker / agent.
Don't spend a lot of time or money without a signed contract.

Unfortunately, as you've learned the hard way, either party can walk away until a contract has been signed.
I don't understand what you mean by "not trustworthy". The sell-side broker's fiduciary responsibility is to the seller, not to the buyer. It sounds like this broker got a deal done for his clients. It just didn't happen to be with you.
According to the OP, the broker made promises the OP relied on and the broker knew the OP relied on them to his/her detriment. After making the promises -- again, according to OP -- the broker stopped returning calls and lied about sending a contract to OP's lawyer.
This is standard operating procedure for a certain type of broker when a better offer comes along. Yes,the broker got the job done for his client, but not ethically or in a way that inspires trust, if what OP writes is true. The broker might be slick, he earned his commission, but reputation is important and the broker's behavior is not impressive.
When you're dealing with unscrupulous brokers and sellers, having a signed contract is not necessarily a protection. I have seen situations like this even after a contract has been signed. In fact, we once were in contract and had put down a substantial deposit with a seller whose broker was still offering the house to other potential buyers until I found out about it.
if you have a complaint about a real estate agent or broker, file it with the NYS Department of State. They're slow but they do investigate.
mrs how did you get approved for a loan without a signed contract? the contract is a core facet of the underwriting process?
I wouldn't be so sure that the broker got the best deal for the client. That would be the one most likely to get short sale approval, without fraud, and fraud (convincing the bank to approve a sale under even the short-sale market value) is an inherent problem with these -- which is why short sales are required to be publicly listed for a certain period of time, not done privately.
I believe Mic Murphy is a "short sale specialist", so he would know how to game the system, and would also know the ethics and laws surrounding such actions.

Recently dealt with him in regards to a rental in Hamilton Heights. After my potential room mate backed out of the deal, telling me that he'd contacted Mr. Murphy to let him know that we were no longer interested, I got an extraordinarily rude text from Mr. Murphy, lambasting me for my 'lack of character and communication'. Loved the property, and would have loved to re-apply with another room mate, but after the way he treated me I have absolutely no interest in working with him. Stay away from this guy!
Araz was this for an apartment at 844 Saint Nicholas? I know someone who was working with him on that apartment. I cant believe he did that to you because he is doing the same thing with someone else!
I want to thank my unhappy customers for bringing this blog page to my attention. I remember every deal because i put blood sweat and tears into all of them.
Case 1. Short Sale Condo apartment on Riverside Drive. As many of you know Short sales are among the most difficult (or impossible) Real Estate transactions imaginable.The Short Sale Bank takes forever to approve a sale price and then give the buyer (broker) only days to respond and close. An FHA loan on a Condo which is not FHA approved is next to impossible due to time constraints. I explained this in detail to these buyers who originally said they had a conventional mortgage and then told me FHA (i won't mention their change of attorney). FHA approval for the loan can take 30-45 days but that process can only begin once a condo plan is FHA approved which is a formidable task in its self. It takes the cooperation of the Developer, the Developers attorney, Property manager,Condo Board, Short sale bank(patience not), seller who wants out of the deal and the maintenence charges asap, buyers attorney,buyers bank, appraisal and did i forget to mention COMPS. I have closed 6 short sales in the past 16 months.I have learned an awful lot in the process. Please remember for deals that do not close i do not receive a single penny. Out of 40 or 50 sales deals and hundreds of rentals since 2007 i'm still batting 900. But i am not a magician.
By the way Short Sales are "price approved" by the bank and there is no out-bidding to be done.I have no money incentive to chose one buyer over another. My only consideration is which buyer can perform given the time constraints. I work for the seller to whom all offers flow.

Case #2. Came to view with the apartment on the 29th of March with a roomate and the roomates mother. He called me approx 4 time to tell me the mothers flight from Minn. would be delayed. No problem. They arrive to see the apartment and fall in love. The mother of the roomate offers to give me a deposit to hold the apartment. Not my policy. Mr Araz says he has to have his father as guarantor because he has no credit. I say fine i will email you the application and please get back to me. Monday, Tuesday i receive the roomates documents but nothing from Mr Araz . The roomates mother calls me again and asks if she can give me a deposit to hold the apartment. I tell her NO not until i have all the applications and necessary docs from both tenants.Weds Thurs Fri Sat..I call Mr Araz he is in Florida with the family and he assures me i will have his docs first thing monday. Monday Tuesday..I send him an email he sends me an email to inform me that his roomate has selected another apt (oh, i thought he told you) but Mr Araz still wants to apply as soon as he finds another roomate...ARE YOU JOKING!!!!And then you write a complaint...
ugh...you're digging a grave faster than your client's complaints are. NOTHING you say here will make you appear in a better light to anyone who uses this board. other than perhaps some people in the real estate industry. schtumm up now for your own good. maybe this will go away if you do.

I agree with falcogold, with one slight modification since w67thstreet posted: I'd drop the 'g' in gape.
My partner and I had a similar experience to Araz and Mrs1007. In NYC where there is smoke there is fire and Mic Murphy is clearly not to be trusted when it comes to financial/real estate transactions. From the dates above it is clear that my partner and I were dealing with Mic Murphy during the same time that he was attempting to rent to Araz. We spent a couple of weeks in constant conversation and communication. At first Mic seemed honest and trustworthy. Then, after giving him all of our financial documents, social security numbers, pay stubs, W2's and bank statements he stopped returning our phone calls and emails. We still to this day do not know if he is an identity thief or not because he wont respond to any communication from us. We were forthright from him in all of our correspondance and did not expect anything but the same from him. After three days of no phone calls or emails from him we thought he had been hurt or injured. I asked one of my colleagues at work to email him to see if he would respond to an anonymous email address and sure enough he emailed my colleague back almost instantly asking her to come see the apartment he was renting us...ARE YOU JOKING???? Why not just man up and let us know whats going on Mic? If you the owner did not want to rent to us or did not accept our offer why not just let us know? All it takes is one phone call or email.
Mic talks out of both sides of his mouth and I really wish that I had been alerted to this blog before I started to work with him. I hope this site alerts and potential new renters or owners NOT to work with this man. There is a pattern of bad behavior here by multiple people that do not know each other. Do not take this lightly. You have been warned.
This is the email that we wrote him on Friday which alerted him to this page:

After meeting and speaking multiple times regarding the apartment at 844 Saint Nicholas I am very disappointed that you have decided to stop communication with my family. Armando and I have both sacrificed our time and energy with you and we have given you access to our most personal documents, account numbers and social security information.
When we last spoke we offered you a brokers fee if we signed the lease and you declined saying that your reputation and referal was more valuable. I am therefore very surprised that you have been so clearly unprofessional with your communication with us this week. We have sent you at least two emails and voicemails that have gone unanswered however you have replied to other potential renters of the unit at 844 Saint Nicholas within minutes. How do you think you would feel if someone were to do this to your son if he were searching for an apartment?

I have previously responded (3/9) to you in a very long detailed email which i see you did not print here as it would clearly show the problems with your application, credit reports etc and render your complaints invalid. All applications are not approved! It is called an application process. You supply all the necessary documents and i pre-screen them for the landlord who once received, ultimately makes the final decision. I have successfully rented 3 of 4 units in the above mentioned property to credit-worthy and very satisfied customers. I have fulfilled all my obligations to the landlord at above market prices (as you have stated hence your offer requiring a 10% price reduction). I waived your application fees $150 (proviso you provide recent credit reports) and i did NOT accept your offer to pay me an additional broker fee (as it is a no fee listing and i am paid by the landlord). How you equate this and question my trust worthiness is unfathomable. Good luck to you in your search.
Hmmm. I dunno Jim, I think Mic has successfully defended himself. Sounds to me like Mic is doing his job well but unfortunately has to deal with idiots.
why the original post is about short sale, but the later post from Mic and partner looks like a rental case????
anyway, the lesson is about do not use FHA, it's one of the main reason of the RE bubble and mess
I like people defending themselves with proofs. To be fair, Mr. Murphy seems doing a reasonably good job.

huntersburg, you are exactly right. The broker rejected a bribe (additional broker fee by the potential renter)and was accused of unethical. What a world we are living in?
generalogoun, what you're saying is that the broker went out of their way to sell an apt that they've ALREADY SOLD, in the hopes to marginally increasing their commission from a slightly higher selling price?? Doesn't make sense. Its hard enough to get a broker to sell an apt once, much less twice for only one fee.

had a meeting with this guy for a property on 783 Saint Nicolas. He was late to the extent that I have to leave for work without seeing the property (we called him a few times and he said "i will be there in 5 minutes).
My broker stayed there waiting for him, and later she told me the guy never showed up.
She also told me that these buildings have endless violations.
Definitely multiple red flags with this guy
