Under NY law what responsibilities does the developer have, if any, and for how long for defects in the unit or common areas. What should people look out for? Examples of issues might be the following:
- problems with fixtures such as hvac system breaking down (there may be a manufacturer's warranty but perhaps it has run since it was installed and has been running for two years while the building is selling)
- basement flooding (are there any causes of this that could be responsibility of developer, such as improper drainage)?
- problems with fixtures such as kitchen cabinet problems or crack/defect in sink or bathtub...
I assume the only liabity for moveable appliances such as dishwasher are whatever the manufacturer offers but for these other examples is it just buyer beware or is there some ongoing responsibility.
