No. If the city finds it you'll have to remove it. See toward the end of http://www.nytimes.com/2011/07/26/nyregion/a-rec-room-is-the-new-way-to-expand-an-apartment.html.

They don't want people making their kids sleep in cellars with no light or air, as in 19th-century tenements.
