developer lists false sale price

I recently made an offer on an apartment in a full-service new condo building. The last apartments were lingering on the market, the price was low. But the developer told the broker that the sale price would be listed at 7% higher than the actual price, with the difference being explained away by fictitious "credits for upgrades and closing costs". Is this legal? The broker told me it is, and that it helps protect the value of the apartment. And if so, is this practice widespread? What do you all say?

definitely common. i was negotiating a place and they told me they'll give cash back at closing and add that to the price with the same reasoning, (helps protect the value of the apartment).

nothing new. the broker can then point to the apartment 3 floors lower and say 'hey that sold for $1M and you're on a higher floor. gime $1.2M and you have a deal.'

acris and the like should be recording the NET sales price, not the bogus one. now that they are adding the other taxes to the sales price, they are only inflating them more.

NYS/NYC collect tax on the larger amount, so wouldn't want to know about the actual lower price.
