will they close down the bank if it doesn't pass..BOA employs over 100k people.

BofA is insolvent. It's only a question of recognizing that. They are hanging on due to Fed Funding. Smartest solution would be a pre-packaged bankruptcy where they shrink and split up the units and force bond holders to convert to equity where appropriate. The people they employ is insignificant compared to tax payer and systemic exposure. Besides who says all those people lose their jobs?

They could force the banks to halt dividends and buybacks and to raise capital. Even curtail cash bonuses. There are many steps before shutting a bank down.
