Discussion about
My partner and I left the Ohm at the end of the May, with the apartment signed off in perfect condition. More than three months later, the management company has still not returned the deposit - of almost $5000. Initially we were told this would be repaid within a month, then within 60 days, then within 90 days. We've called endlessly, and paid the on site manager a visit, always to be reassured that its being dealt with and about to be repaid.... but still nothing happens. I would really like to know if other people are having the same problem, or whether its just us.

30 days from now, file a suit in Small Claims Court:
http://www.nyc.gov/html/dca/html/publications/publications_small_claims.shtml

if you have an especially busy personal schedule particularly in the evenings, call the listed number in advance and ask what date they are calendaring for trials. The person you talk to - in fact, no one - can change that date (so don't complain - do the opposite and be polite), but the next day it will be different (could also be different in the afternoon vs. the morning). If the date suits you, get there that day and file your complaint. Bring the exact name and address of the landlord as it is stated on the lease.

You can always revoke your case if you are paid.
