Oh lord, my sister's landlord is trying to screw her out of her rent stabilized apt. He was supposed to send a lease renewal like, 90 days ago and her calls and emails are going entirely unanswered (although he is continuing to cash her rent checks - a good sign, I know). She has been there 10 yrs, never had a prob, never paid late. I know a great property attorney but no rental attorneys - please help guys and thanks so much in advance! ps - poor kid is in her final semester of grad school - quite literally the last thing she needs

It's OK. If all a landlord had to do to get rid of a RS tenant was not send a lease, there wouldn't be any left. Go look on tenant.net or somewhere like that.

You have to navigate through, but they have tenant attorneys who answer questions. There are tons of threads of different issues, I'm sure you can find answers to this question.

In itself, not receiving a renewal lease isn't a big deal. Happens all the time, Has your sister responded promptly to all DHCR information requests?
This is a non-issue. The law is 100% on the tenant's side in this case for a rent regulated tenant. In fact, the tenant gets extra benefits:
a) Landlord can't receive an increase that would have come with the renewal
b) Tenant now has a month to month option
Landlord is required to provide a lease according to the law. Absent the landlord providing the lease, the tenant loses no rights of tenancy. Hiring a lawyer will just cost the tenant a cost of hiring a lawyer, and the most a lawyer will get for the tenant would be a renewal lease, which would then restart the monthly rent at the higher post-renewal (per the regulations) rent.

Huntersburg is entirely correct. It is to her benefit. I was in a stabilized apartment for 4 years without a lease. Never had a rent increase. Yes, the landlord wanted us out. But he couldn't do anything about it. This is a non-issue.

Hmmm - where were all of these attorney recs when Foolishrenter was looking for tenant-side attorney? Personal bitterness aside, I am glad there are now a number of names on the board. I am following a case that Elizabeth Donoghue from HMGD&J (W81st's rec above) is handling and like their work.
