Brokerage Has Listed My Home For Sale!!

Discussion about
I briefly listed my apartment FSBO last spring before taking it off the market. Time passes... This week I am surprised to see a small brokerage firm (with whom I have never had any relationship) has used my pictures and listed my home for sale! On their own website they even say "EXCLUSIVE!". What would you do?

You can file a complaint with the Department of State. It's a pretty straightforward process.

You're a finance guy.
You never signed a listing agreement with them.

streeteasy isn't the place to get the facts down in print --
e-mail the brokerage firm with the details you provided above.
If you get a buyer first, on your own -- SOLD!

if they get you a buyer --SOLD!!

Because you will have all of the details of the buyers' contact with/from you:
e-mails ( just don't rely on telephone calls, each inquiry must be submitted via e-mail to you.).

If not, why did you take it off the FSBO listing?

Bernie: it sounds like the listing Realtor is a clientless agent.

I once knew of an old woman who is a talentless clientless publicist, but that doesn't stop her one bit.

alanhart is trying, yet again, to refer to me and engage me in a fight on streeteasy.

He "carries on incessantly.", "but that doesn't stop (him) one bit".

alanhart can't help himself: he can not contain his attempts to provoke me, trying to start a fight here on streeteasy.

Attempts such as these only underscore his lack of any "talent" and his need to try to engage me.
He has nothing better to do.

Bernie:

1. several brokers have done that with my rental ads
2. while I am still trying to rent
3. one even advertised as owner of my apt
4. falsely advertising your apt is grounds for licensing sanction or revocation
5. call the broker ASAP and tell them you want your listing taken down within 2 hours

@greensdale: the apartment is currently not for sale.
@Truth: I listed the apartment for only 4 weeks last year (work plans for move to London fell through). Also the price they are "asking" is quite low - obviously more attractive bait for the bait & switch. But this could impact the price I get if I decide again to list in the future.

Yes I will contact the brokerage directly. I was just amazed at the sheer brazenness, especially advertsiing it as an exclusive.

that's a reason to go to them and complain.
Send them an e-mail with the listing.
Then proceed with the suggestion posted by w81st.

(How did they plan to show the apartment?! Maybe it was a bait and switch.)

I would file a formal complaint first, as West81st said. OTherwise, the listing might not exist long enough to do so!

Definitely should get their come-uppins'!

The even used MY JPEGS and write-up! Bottom feeders. BTW They pulled it from their site within 60 seconds of my email to their CEO (literally just now).

1. you are right about false advertising affecting your price if you sell
2. the brokers who falsely advertisied my rentals screwed up my rental cycles
3. some even undercut my asking price in order to lure my prospects

4. since the firm president pulled your ad instantly it doesnt sound like the firm acquiesced
in the posting but rather that it was the act of an individual agent

5. at least two of the firms which falsely advertised my rentals were really hostile and
uncooperative when I asked them to pull their ads

Despite what caonima and a couple other naysayers, it's only too bad now that you can't file an official complaint. I would have done this first. This type of unethical, and in some ways illegal, behavior happens all the time. I'm sure you were just one of many -- that firm and others continue to behave this way until something official is filed. Notice how you didn't notice anything was different until you noticed the listing for yourself. So, obviously, they were using it for bait and switch. Even if someone WAS interested in your property, the firm wouldn't tell you for fear of getting caught. Pure sleazy bait and switch.
