Discussion about Fairmont Manor at 401 East 86th Street in Yorkville
I lived in a co-op where they installed new elevator motors in a new area of the basement. The owner of a huge apartment on the first floor could not use several rooms in his apartment due to the ongoing noise and vibration from the motors. The same law firm, as you mentioned, represented the co-op and they received a similar letter to the one on page 27. This turned into a long running law suit. Meanwhile, the co-op cancelled the owner's lease to a huge store room he had been using for his business for many, many years. I believe they eventually moved out.
Now Duane Reade has weighed in: https://iapps.courts.state.ny.us/fbem/DocumentDisplayServlet?documentId=wKO_PLUS_oxNw8I6V/5fkcgAMBw==&system=prod
Their response and the co-op's (https://iapps.courts.state.ny.us/fbem/DocumentDisplayServlet?documentId=0UNgL77nASqXPka9son9pg==&system=prod) seem pretty persuasive, but we'll see....
