As long as it is partitioned with windows, it is a 3br apt.
If you don't like the layout, just move along...no need to bitch on public forum with your taste.

ba294, you forgot that it also needs to have a legal closet, which according to the floorplan, it doesn't. So no, it's not a 3BR, which is misrepresenting and deceptive. Furthermore, since when has Streeteasy NOT been the place to bitch about these things?
In NYC there're no regulations requiring a so-called bedroom to have a closet. Maybe some other jurisdictions, but not NYC.
If you want to use a room as a bedroom, you can always get a piece of furniture to store clothes, as in Europe.

You do not need a closet to legally call it a bedroom, but you do need a window in a bedroom.
If closet was mandatory, one can just build one in few hours.
