I hired an architect to renovate my apartment. Our contract was an hourly rate to be capped at 20% of construction fees. The design process was prolonged partly because the coop rejected our initial plans as being noncompliant with the NYC building code. When I received a bill which exceeded our agreed upon cap I refused to pay. The architect claimed she "could not continue to work for no pay" and terminated the contract (which either party was allowed to do in a provision in the contract.) Now, however, she continues to pursue the payment in excess of the cap and has threatened to send me to collection. The amount in dispute is about $9000. Do I have any options to fight this? meanwhile I have paid her about $30,000 and have only a handful of plans to show for it.
