My wife and I are buying a co-op apt. and the sellers have been stalling the process, which resulted in our mortgage rate lock expiring and us losing points, and scheduled a closing a month after we got approval from coop and bank, and now tells our lawyer that she will not be ready to move out for 9 days after the closing. According to our contract, the place is supposed to be vacant, broom-cleaned and in the same condition as the inspection prior on on closing date, and after that it's all on us. Also the contract states that we must start paying maintenance, mortgage and take full responsibility for the apartment. Also, we are only allowed to move in on a weekend, and of course she chose Sunday as her move-out day, so we 'll be stuck paying 2 weeks of rent for our old place, maintenance and mortgage for our new place, while it is occupied by a stranger who is legally not obligated to keep the place in good order. Any recommendations? Should we insist on not signing until she is ready to move out? We really want the place and went through freaking hell to get approved by the co-op board. Any comments on that? Do we have any legal leverage to rush the seller? [less]
