delayed closing

I am buying a condo for the first time. The sponsor has failed to close since we signed the contract in June. Apparently they do not have the required minimum reserves and they said it will awhile. I read my contract and it does not seem to give me an "out" clause. Is there anyway I can get out of my contract and get my 10% deposit back?
