Sale fell thru - Broker entitled to commission?

Received several bids with my apartment with the highest at 3% just below ask; agent is very pushy to accept, though I feel I can get more and his listing agreement expires soon. If I back out since I didn't get my EXACT # on listing agreement, is broker entitled to commission since it's CLOSE to the number?
