dual agent and buyer's agent

Hello I'm trying to understand the ny agency disclosure. I received an agency disclosure from the seller's agent that has both dual agent and buyer's agent checked off. Is it necessary to have both checked off? I thought only the dual agent section would be checked. If the agent is representing me only with the sale of this particular client/seller's property is it necessary for me as a buyer to have this person as my buyer's agent? I just want to make sure I understand the form and do not have to be married to an agent if the sale falls apart.
