I was approached by a broker who stated she had a buyer that was interested in buying my apartment. I do not have my apartment officially up for sale, so do I need my own broker to represent me if I wanted to sell?
No. Attorney, yes. Most likely this broker has somebody that it's interested in purchasing a unit in your building. It doesn't sound like the buyer has actually seen your unit since it's not on the market.

Do not sign any agreement with this broker to pay commission unless it is for a specific buyer. If you do pay commission for this buyer, should be only 2.5 percent with a representation that they are not collecting anything from the buyer.
I'm more suspicious than Keith, and think that the broker was just fishing for a listing, so I'd be inclined to turn her down. But, if you go down this path, watch out for signing any sort of agency agreement.
I get mailings every few months that I have an interested buyer. They are just trying to get you to sign an agreement with them to sell.
This happened to me once. A broker dropped by my weekend house and said he had a very interested buyer. I suspect this was true as buyer apparently did not need to see the house. He wanted to keep buyer identity secret so I suspected it was a neighbor. In any case, I signed a listing agreement for one buyer only and made the agreement for only 30 days. In the end, offer was a real low ball and that was the end of that.
