Best and final for rentals?

I attended an open house tonight for a rental apartment where the broker said he is asking for best and final offers on both the rent and his commission - i.e., the rent will not be the rent advertised in the listing but the highest offer from applicants, and he will give preference to applicants that offer him the highest commission. Is this normal? Or legal? It was a first for me.
