Why is this listing considered a "Penthouse"

Discussion about 10 Park Avenue #PH25A
If there are 3 floors of apartments above this listing, why is this being called a "Penthouse" ?

Probably because it is on a setback. The term 'penthouse' is more loosely bandied about these days.

I've lived in buildings with 3 floors worth of "penthouses" and in buildings where the "penthouse" wasn't the highest floor.

It's a meaningless term of art used in brokerbabble.
It also looks a lot cooler than 15A as a unit number.
