Tenants asking for painting

Discussion about
Tenants moved into a well maintained apartment and immediately asking for repainting. This has been owner occupied prior and first tenant. NYC code says occupied units have to be painted every 3 years. But is this only for tenants who have been there 3 years or new tenants as well?

Is this a condo or what is the situation?
What is the rent & size?
Are the tenants paying themselves or being covered by a third party, eg daddy?
