I am buying a coop apartment. After the offer is accepted, I was then told that the Jacuzzi is a violation and the Board has informed the owner to remove it, but the owner is just going to sell the apartment as is. I was told in one instance that because the Jacuzzi leaks to a neighbor’s apartment and they complained it to the Board, but when I asked further information on this later on, the seller denied such saying and simply stated that they don’t know if it leaks or not, they were just told by the Board that it needs to be removed. What should I do? How do I find out if there is a leaking or not?

Talk to you attorney. I would ask for the replacement of the tub as part of the contract. If not, move on, there is plenty of inventory out there.

Agree with above post. Seller should fix it and any damage to unit below prior to close.

If you agree to buy it under the present conditions, you should negotiate a lower price to reflect costs to repair plus 20-30% for your time and hassles. Also, you want to make sure that there is no damage to the unit below for which you can be held liable. You could do this via inspection of that unit (hard to arrange) or via a representation by the seller in the P&S supported by monies held in escrow for some period of time which can be used to effect repairs.

If seller squawks - buy some other apartment.

If this all sounds like a pain-in-the-ass after all the money you are spending - buy another apartment.
