Can managing agent of a condo

impose a new fee on owners who renew lease with the same tenant? I got a letter from Douglas Elliman who manages the condo in which I am renting. The letter asks for a $300 for renewal processing fee. As far as I know they are doing this without the board knowledge or approval (my brother serves on the board). The claim that my current tenant will be considered an illegal tenant if I do not send a new lease. I would like to file a class action lawsuit against them to teach them a lesson. Thanks for your feedback.

Wouldn't it be easier to fire them and hire a new manager?

It is actually a lot of work to change management agent. However, if it was up to me only, I would do that.

Why don't you send them a $600 bill as your fee for processing their $300 processing fee?

i love everyone on these boards who is ready to sue at the drop of a hat. i presume few of them have any real experience of a law suit. note: one key part of any lawsuit is provable damages. some far, i cannot see how you have been damaged. and, if you pay the $300, I cannot see how your damages could be greater than $300. i think you'll find it difficult to find an attorney willing to work on a contingent portion of your $300; I also suspect that your first conversation on a non contingent basis will cost you at least $300.

First, if I pay $300, I would have a damage of $300. I am sure that this management agent has done this to many others. Why should they get away with this. Are you an attorney? If not, why make it sound like you know what you are talking about?
