Signed contract yesterday wired money changed mind

I signed a contract yesterday and 10% was wired to seller. I changed my mind today and want to get out of the deal. Is there anything I can do?

Has a counter-signed copy been given to you yet? I am no lawyer, but I don't think a contract is considered executed & binding until that happens, so you may rescind your "offer" prior to that "acceptance". Talk to your lawyer.

The seller has the contract you've both signed, and the 10%. The seller has now relied upon that and gone ahead with whatever plans depended upon selling the apartment.

Have your lawyer ask the seller's lawyer to kindly tear up the contract and return the 10%. Maybe you'll get lucky. Generally, though, the cost of mind-changing is 10%.

Buyer's remorse ... very common at exactly this point in the process. If you made it far enough to sign & wire, deep down inside you want to go through with it.

Just have a few sidecars with every meal, and between-meal nosh on valium, until the deal closes.

In many cases, the 10% was sent by just a personal check. If they required you to wire the money over instead, it is not a good sign that they will let you off the hook so easily. Of course, it still doesn't hurt asking. Even if they agree to return the money, be prepared to lose a big chunk of it to pay up the whatever transaction cost the seller may ask for.

Call your attorney today, as I trust you have by this hour.

Call your bank and see if you can halt the wire. It's not instantaneous money transfer.

Vic is right, usually this is a personal check deposit which might give a buyer a little more wiggle room--you can stop payment on a personal check.

Think I just had drunk cold feet. Not gonna stop the deal...just hard to spend that kind of money. Thank you all for the advice

You're not gonna to stop the deal if they refund your 10% deposit? If they do give your 10% back will you change your mind again and rewire the money back to them? If you do that and then change your mind for the 3rd time I have a hunch (and I'm no betting man) they probably won't give your 10% back to you again.

did you just win a bidding war and ended up paying more than your maximum, but you justified paying up due to low monthlies given an abatement?

Spot on, it happens either right after you send the deposit check or the moment you cross the threshold of the door after closing. Doesn't last more than a day.

You cannot back out. You will be in breach of contract if you stop payment on the wire. Owner can go to courtand you can be forced to give the 10K. There is no way to not lose the 10K unless the owner agrees to void the contract. There is no buyer's regret in NY state and once again BUYER BEWARE, the apartment you buy is as is.
